Divorce Requirements in Oklahoma

Also called a dissolution of marriage, Oklahoma defines divorce as the legal termination of a marriage. Oklahoma is a “no-fault” state, which means that you are not required to provide a reason beyond “irreconcilable differences.” No-fault divorce tends to be most common, although you may file for divorce on fault-based grounds, such as abandonment, adultery, or extreme cruelty.

To file for divorce in Oklahoma, you must also be a resident of the state for a period of at least six months. For the county you are filing in there is also a residency requirement of 30 days.

For uncontested divorce in which no children are involved, a divorce can be finalized 10 days after filing. Otherwise, there is a minimum waiting period of 90 days.

Yes. In Oklahoma, if you and your spouse are able to agree on the terms of the divorce and have both signed a decree, only one party will have to go to court to provide a short testimony. You must still complete any requirements ordered by the court, though.
